ARTICLE 29-30       REVERSION TO ACREAGE

Section 29-30-1       Public Hearing

The Council may hold a public hearing to determine whether the approval of a Final Subdivision Plat should be revoked if one or both of the following conditions exist.

  1. Lots in a Subdivision whose plat has been approved and officially recorded have not been sold within three (3) years from the date the plat was recorded.

  2. Improvements such as streets and utilities for a Subdivision as required in this Chapter have not been added within two (2) years from the date the plat was recorded.

Section 29-30-2       Revocation of Plat

The revocation of the plat shall become effective when a certified copy of the Resolution of the Council, as a result of their public hearing, is officially recorded.  All streets, rights-of-way, easements dedicated or offered for dedication on Subdivision plats shall no longer be valid or of effect.

Section 29-30-3       Abandonment of Subdivision Lots

Abandonment of Subdivision lots and reversion to acreage may be initiated by property owners petitioning the Council for consideration on all of, or portions of, the Subdivision Plat.  Such a petition may require consideration for rezoning.

Section 29-30-4       Planning and Zoning Commission Evaluation

  1. Any action considered by the Council relating to revocation of all or part of a Subdivision shall be referred to the Planning and Zoning Commission for evaluation on:

    1. Correlation with the Town Plan,

    2. Correlation with proposed development in adjacent areas,

    3. Recommendation as to whether zoning changes should accompany revocation, and

    4. The effect of revocation on existing developments.

  2. Any other action applicable to the above process and permitted by State Laws are permissible.

Section 29-30-5       General Regulations

Requisite actions under Article 8, Chapter 20, Title 28, of the Arizona Revised Statutes to abandon the streets and easements should be carried on separately and simultaneously with any procedure to abandon a Subdivision or revert it to acreage.
